I hereby swear or affirm the following statement:
In July of 2001, I was incarcerated at the Ouachita Parish Correctional Center in Louisiana. At one point, I was housed in A-Pod 10-C. At this time I slept in an area with two bunk beds inhabited by Glen Dale Nelson, Vacarra Comanche, Clarence Kennedy and myself.
I was approached by Vacarra Comanche and asked to join a scheme that he had decided to act on against Tony Hunter, also known as Trigger, who was also incarcerated at the facility.
Comanche asked me to lie. He wanted me to say that I had overheard Glen Dale Nelson and Tony Hunter arguing. He wanted me to say Hunter was outside, and Nelson was by the bunk where I had been sleeping. He wanted to lie and say that I heard them arguing about a murder. He wanted me to say that Tony and Glen Dale argued about the location of a murder weapon, about some kids who were killed who weren’t supposed to be there, and he gave me more details I have forgotten.
Clarence Kennedy told me at the time that he robbed a white lady and that he was told he would get less time for his crime if he was willing to testify against Tony Hunter.
I told them both that I would not be willing to lie about this.
Further:
When I was incarcerated at Ouichita [sic], I slept as lightly as I ever had. I considered that place a dangerous place and sleeping was not safe. I would, and could never have slept through an argument loud enough to be heard through the window in that area. I can’t even imagine being able to hear anything outside.
I understand that Clarence Kennedy gave a statement to the police that said I was present and sleeping through this interchange between Nelson and Hunter. That is a lie, just like the lie that Vacarra Comanche asked me to tell.
I offer this information freely and am willing to testify under oath as to its authenticity. I have no relationship with any of the people in that pod with me nor do I know Tony Hunter. I haven’t seen or spoken to any of them since I left the facility.

Why this document matters: Kennedy testified that Rucks was the only other person present — asleep on the bunk above him — during the conversation he claimed to overhear. The person he named swears he was awake-natured, was solicited to join the scheme, refused, and that Kennedy’s account of him “is a lie.” The other half: no court has held an evidentiary hearing on this affidavit; the application presenting it was denied.
